"Enforcement" – An Interesting Concept

The new department at SSEC provides measures to prevent, uncover and stop entities engaged in the international transfer of controlled commodities, from violating Ukraine’s national legislation, international agreements and obligations in international export control regimes.
To this end, SSEC has a continually updated database with information about Ukrainian companies engaged in international trade and their foreign counterparts who have violated Ukraine’s legislation and international law. Information exchange on these violations has been set up between SSEC, law-enforcement agencies of Ukraine, and foreign export control agencies. Inspections of cargo and documentation that crosses the state border of Ukraine are being carried out together with the Customs and Border Guard agencies.
Last year, a total of 1999 applications were examined for the right to internationally transfer controlled commodities. In addition, 414 applications to register firms and 31 applications to obtaining special authorization were reviewed. 40 companies were checked through the Ministry of Foreign Economic Relations and Trade and the Ministry of Foreign Affairs. Taking into consideration information received from the ministries, the following firms were deprived of permits for the reasons stated.
- “ 3 Part Ltd.” (Slovak Republic) on the grounds that this firm does not have an import certificate;
- “ Globe Commercial Agencies Ltd.” (Sri Lanka), on the grounds that the government of Sri Lanka forbids participation of firm-agents to engage in the purchase of military equipment;
- “ Firstpoint Limited” (Switzerland) on the grounds that this firm is not in the State Registry;
Similar reasons for permit refusal to other firms were received from Ministry of Foreign Affairs, Security Service of Ukraine, the Ministry of Foreign Economic Relations and Trade. Bulgaria and the Czech Republic forwarded a list of companies that have export/import licenses for military commodities in accordance with the Wassenaar Arrangement. This list permits the elimination of permit applications to these companies and expedites not only application review and but also international transfers of controlled commodities.
